Terms and Conditions

The following Terms and Conditions form the basis of your contract with Protrek Adventure Pvt. Ltd. Please read them carefully as they set out your rights and obligations, as well as ours. By asking us to confirm your trip booking, whether through our website, email, or through our authorized booking facilitator, you acknowledge that you have had the opportunity to read, and have read, these Terms and Conditions in their entirety, and that you agree to be bound by them. These Terms constitute a legally binding contract between Protrek Adventure Pvt. Ltd. and all persons participating in or receiving services from our operations.

1. About Protrek Adventure Pvt. Ltd.
Protrek Adventure Pvt. Ltd. is a government-registered company and a trusted name in mountaineering, peak climbing, and trekking in the Himalayas. The company is established under the Company Act 2053 and Tourism Act 2035 (Registration No: 236688/076/077 | PAN No: 609744277). Protrek Adventure is licensed by the Department of Tourism, Nepal (License No: 2845), and is a registered member of the Nepal Mountaineering Association (NMA Reg. No: 1526). The company is additionally authorized by Nepal Rastra Bank (NRB), the central bank of Nepal, to engage in foreign currency transactions with international guests and overseas travel agencies.

All on-ground operations, logistics, guide services, expedition management, accommodation arrangements, and all other services delivered in Nepal are conducted solely by Protrek Adventure Pvt. Ltd. from our office in Kathmandu, Nepal. Protrek Adventure Pvt. Ltd. is committed to delivering safe, authentic, and exceptional Himalayan experiences, and remains the sole entity operationally responsible for the delivery of all trip services.

2. Treks and Expeditions
Protrek Adventure Pvt. Ltd. organises and operates adventure trips in the Himalayas and other remote mountain environments. Participants must be fully aware that accommodation, transport, safety infrastructure, hygiene standards, telecommunications, and medical facilities in these environments are not comparable to those available in urban settings or on conventional holidays. This type of adventure travel inherently involves a high degree of personal risk, physical challenge, and exposure to unpredictable natural conditions, which you agree to fully acknowledge and assume as a condition of booking with us.

By booking a trip with Protrek Adventure Pvt. Ltd., you confirm that you have independently assessed the risks involved, that you are aware of the physical demands of your chosen itinerary, and that you voluntarily choose to participate in full knowledge of those risks.

3. Itinerary and Trip Prices
Prices for all trips are regularly reviewed and the company reserves the right to amend them at any time. The current price will be confirmed at the time of booking. If a trip is cancelled or postponed due to flight delays or cancellations, adverse weather, or other travel disruptions, Protrek Adventure Pvt. Ltd. will not be liable for any compensation or additional costs incurred by the participant as a result.

Payments already made are non-refundable in cases of itinerary changes or substitution with an alternate trip, unless expressly provided for under the Cancellation Policy set out in Section 11. Quoted prices do not include applicable government taxes unless expressly stated. Protrek Adventure Pvt. Ltd. reserves the right to impose surcharges on any booked services where increases in transportation costs, fuel costs, government taxes or levies, local operator costs, currency fluctuations, or government action impact the price of the applicable services. Notice of any such surcharges will be provided to the participant as promptly as practicable.

Temporary promotional offers may be introduced or withdrawn at any time without prior notice. Participants who have already confirmed and paid a deposit under a promotional price will not be affected by subsequent withdrawal of that offer.

4. Validity, Flexibility and Unused Services
All trip dates, itineraries, and prices are subject to change at any time due to a variety of circumstances, including but not limited to permit availability, snow and weather conditions, natural disasters, political or local situations, or other factors beyond the control of Protrek Adventure Pvt. Ltd. You acknowledge that you are responsible for keeping up to date with the specific details of your trip and any communications sent to you by our team.

Scheduled routes, accommodations, activities, amenities, and modes of transportation may be modified without notice where necessitated by unforeseeable circumstances or events outside our control, including but not limited to force majeure events, illness, mechanical breakdown, flight cancellations, adverse weather, strikes, or local disruptions. No reimbursements, discounts, refunds, or alternative trips will be provided for services that are missed or unused due to no fault of Protrek Adventure Pvt. Ltd., including but not limited to vehicle delays, mechanical breakdowns, flight cancellations, bad weather, illness, personal reasons, political events, or your removal from a trip due to your negligence or breach of these Terms.

5. Trip Booking
Bookings may be made by contacting us via email, telephone, or directly through our website at www.protrekadventure.com. The person making the booking must be at least 18 years of age and must possess the legal capacity and authority to enter into a binding contract. Where a participant makes a booking on behalf of other members of a group, it is deemed that all other members of the group have consented to and accepted these Terms and Conditions in full.

All names and identity documents provided at the time of booking must be legally valid. A booking is considered provisionally held upon receipt of a completed Booking Form. It is considered confirmed only upon receipt of the required deposit and issuance of a written booking confirmation by Protrek Adventure Pvt. Ltd. The Company reserves the right to decline any booking at its sole discretion, including where a proposed participant is deemed physically unsuitable for the selected expedition or where the trip cannot be safely operated under prevailing conditions.

6. Age Requirement
Any individual under the age of 18 is considered a minor. Unless otherwise specified in the trip description or communicated separately by Protrek Adventure Pvt. Ltd., the minimum age for participation in any trip is 12 years. All bookings involving a minor are subject to review and prior approval by Protrek Adventure Pvt. Ltd.

Minors must at all times be accompanied by a responsible adult who will be jointly responsible for securing all necessary consents, documentation, and legal permissions required for travel to and from the applicable destination. The accompanying adult is jointly responsible for the behaviour, wellbeing, supervision, and monitoring of any minor in their care throughout the duration of the trip. By making a booking that includes a minor, the accompanying adult accepts these Terms on behalf of that minor, including all assumptions of risk and limitations of liability contained herein.

7. Trip Deposit
A non-refundable deposit of 10% to 30% of the total trip cost is required to confirm your booking. The exact deposit percentage depends on the nature, duration, and logistical complexity of your selected trek or expedition, and will be communicated clearly by our team at the time of booking.

For expedition bookings involving high-altitude climbs, the deposit may be proportionally higher to account for advance costs associated with peak royalties, climbing permits, domestic flights, and other pre-arranged logistical requirements. The applicable deposit amount will be clearly stated in your booking confirmation email prior to payment.

The deposit is non-refundable in all circumstances except those expressly outlined in the Cancellation Policy in Section 11. Where a cancellation qualifies for a refund under that policy, any refund of amounts paid beyond the deposit will be processed after deduction of applicable bank processing charges, government taxes in accordance with applicable government tax authorities and regulations, and any non-recoverable costs already incurred by Protrek Adventure Pvt. Ltd. on behalf of the participant.

8. Remaining Balance & Final Payment
The outstanding balance of your trip must be settled in full prior to the commencement of your trek or expedition. Our team will communicate the applicable payment method, accepted currency, and payment deadline upon issuance of your booking confirmation. Protrek Adventure Pvt. Ltd. reserves the right to withhold commencement of any services until full payment has been received and confirmed.

Failure to settle the remaining balance by the communicated deadline may result in cancellation of your booking. In such cases, no refund will be provided for the deposit or any payments previously made, as Protrek Adventure Pvt. Ltd. will have already incurred substantive advance costs for accommodation, permits, guides, and logistical arrangements on your behalf. Any payment received after the trip commencement date will be deemed ineligible for a refund.

9. Payment Options & Bank Account Details
Protrek Adventure Pvt. Ltd. offers two payment options to accommodate participants from all regions. Participants may remit payments through either of the following options depending on their location and preference. Our Adventure Specialists are available to advise on the most suitable payment option for your booking.

Nepal Bookings — Bank Transfer
Participants who wish to remit payment via international bank or SWIFT wire transfer may do so using the Nepal bank account details provided below. This option is available for deposit payments from all countries. Please note that any payments beyond the initial deposit made through this account are subject to the 13% VAT charge as detailed in Section 10.

10. Processing Fees & Applicable Charges
The following charges apply in addition to your quoted trip cost.

Deposit Payments:
Card and online gateway payments made at the time of deposit are subject to applicable credit card processing fees.

Post-Deposit Payments:
Any payments made beyond the initial deposit, whether via credit card, debit card, online payment gateway, or international bank or wire transfer, are subject to an additional 13% charge. This charge is applied in accordance with Nepal’s statutory Value Added Tax (VAT) obligations applicable to tourism, trekking, and expedition services as mandated under Nepalese law. This is a government-mandated tax and is not a discretionary fee imposed by Protrek Adventure Pvt. Ltd. Participants wishing to minimise additional charges are encouraged to contact our team to discuss available payment options prior to making post-deposit payments.

Invoicing & Confirmation:
An updated invoice will be issued within 24 to 48 hours of receiving any card or online payment. For bank transfers, a payment confirmation will be sent once funds have been received and verified by our accounts team. Participants are responsible for retaining all payment confirmations and invoices for their own records.

11. Cancellation Policy
If you wish to cancel your trip, you must notify us in writing by email to info@protrekadventure.com. Cancellations are processed exclusively by email. The cancellation date is the date on which written notice is received and formally acknowledged by Protrek Adventure Pvt. Ltd.

• Cancellations prior to 45 days from the start of the trek—80% refund of the full trip price
• Cancellation between 45 days and 20 days to the start of the trek—50% refund of the full trip price
• Cancellation less than 20 days to the start of the trek—no refund

All refunds are calculated on the basis of the total trip cost actually paid. Any refund approved under this policy will be processed after deduction of applicable bank processing charges, government taxes in accordance with applicable government tax authorities and regulations, and any non-recoverable third-party costs already incurred by Protrek Adventure Pvt. Ltd. on behalf of the participant, including but not limited to permits, airline tickets, and accommodation pre-payments.

No refund will be made if you voluntarily leave a trip for any reason after the trip has commenced. No refunds will be provided for any accommodation, flights, transportation, sightseeing, meals, or services not utilised by you.

Cancellation by Protrek Adventure Pvt. Ltd.
Protrek Adventure Pvt. Ltd. reserves the right to cancel any trip, including a guaranteed departure, prior to the start date for reasons beyond its reasonable control, including but not limited to natural disasters, political or social unrest, civil disturbances, industrial action, war, epidemic, quarantine, government intervention, permit or visa issues, transportation disruptions, or extreme weather conditions. In such cases, no alternative trip, postponement, or refund will be provided, and Protrek Adventure Pvt. Ltd. accepts no responsibility for any additional expenses incurred by the participant in preparation for the trip, including non-refundable airline tickets, equipment, clothing, or medical expenses.

Where Protrek Adventure Pvt. Ltd. itself initiates the cancellation of a guaranteed departure for reasons directly within its control and not attributable to any external circumstance, it may at its discretion offer an alternative trip or postponement. This discretionary offer applies only where the cancellation is made directly by Protrek Adventure Pvt. Ltd. and is not triggered by weather conditions, natural disasters, flight delays or cancellations, transportation disruption, political events, government restrictions, permit or visa issues, or any other external force majeure circumstance.

Participants are responsible for reviewing this cancellation policy in full before making a booking and before the departure date.

12. Changes to Bookings
Requests to amend trip dates, itineraries, group composition, or other booking details must be submitted in writing by email. Protrek Adventure Pvt. Ltd. will endeavour to accommodate reasonable amendments subject to availability and operational feasibility. Amendment requests received fewer than 30 days prior to departure may be subject to administrative fees and the cost of any non-recoverable third-party expenses already committed on behalf of the participant.

Protrek Adventure Pvt. Ltd. reserves the right to make reasonable modifications to itineraries, accommodation, transportation arrangements, or scheduling where necessitated by safety considerations, weather conditions, permit availability, or other operational factors outside its control. Such modifications do not constitute a breach of contract and do not entitle the participant to a refund, unless a modification so fundamentally alters the nature of the trip as to render it materially different from what was booked.

13. Trek Physical Fitness
Our trips take place in remote mountain environments where limited or no sophisticated medical facilities exist. While a medical emergency is not commonplace, our teams are trained and equipped to respond appropriately should one arise. We operate in often extreme and challenging terrain, and most of our treks demand a high degree of physical fitness, stamina, and good general health. Trip durations range from one to eight weeks, and participants must be in sound physical and mental condition prior to departure.

You accept full responsibility for any and all costs associated with any illness, injury, or medical condition that may occur during your participation in a Protrek Adventure trip. Protrek Adventure Pvt. Ltd. reserves the right to deny any participant permission to continue on a trip at any stage, if our guide team determines that the participant’s physical or mental condition renders them unfit to continue or poses a risk to themselves or to others. In such cases, the participant will be required to return at their own risk and expense, and no refund shall be due. Physical conditioning prior to departure is strongly recommended for all participants.

14. Health Information
It is essential that participants with pre-existing medical conditions disclose these to Protrek Adventure Pvt. Ltd. in writing at the time of booking. Medical and evacuation expenses arising during the trip are the sole responsibility of the participant. Participants are strongly advised to consult their physician regarding vaccinations, altitude-related health risks, and any other medical requirements applicable to their destination before departure.

Protrek Adventure Pvt. Ltd. reserves the right to require a medical certificate prior to confirming your booking or prior to departure, and may require a medical disclaimer form to be completed on your arrival day. Your personal safety is of paramount importance to us, and it is therefore imperative that you inform us in writing at the time of booking of any condition, whether medical or otherwise, that requires special care, attention, or medication, and which might affect your experience or the safety of others.

All past and present medical conditions, previous surgeries, and known health issues must be disclosed, particularly those that may be triggered or exacerbated by sustained physical exertion, high altitude, cold, or limited access to medical facilities. You must carry sufficient supplies of any medication required for your current or recurring medical condition for the entire duration of the trip. You acknowledge that providing false or incomplete health information may endanger both your own safety and the safety of others on the trip, and that Protrek Adventure Pvt. Ltd. shall bear no liability for any consequences arising from such non-disclosure.

15. Risk Factors and Awareness
You acknowledge that trekking and mountaineering in the Himalayas entails known and inherent risks, as well as unanticipated risks, which could result in physical injury, illness, death, property damage, or other loss. You confirm that you are fully aware of these inherent risks and understand that they cannot be entirely eliminated, and are an unavoidable aspect of adventure travel of this nature.

These risks include, among others: the hazards of walking on uneven, steep, and remote terrain; slips, trips, and falls; forces of nature including weather changes, earthquakes, and avalanches; exposure to insect bites and altitude-related illnesses including acute mountain sickness (AMS), high-altitude cerebral oedema (HACE), and high-altitude pulmonary oedema (HAPE); hypothermia and cold-related conditions; physical exertion in conditions of reduced oxygen; the potential unavailability of helicopter rescue or emergency evacuation; and equipment failure despite proper care and maintenance.

You accept that your participation in all Protrek Adventure trips is entirely voluntary. You confirm that you elect to participate in full knowledge of all risks involved, and that in the event of any accident, illness, or injury, you will not hold Protrek Adventure Pvt. Ltd. or its booking facilitator wholly or partly responsible, to the fullest extent permitted by applicable law.

16. On-Trip Behaviour
The tour leader or local ground operator representing Protrek Adventure Pvt. Ltd. has overriding authority on all our trips. By confirming your booking, you agree to respect and adhere to the authority and instructions of our trip leadership at all times.

If you commit any illegal act during the trip, or if, in the opinion of the tour leader or ground operator, your behaviour is disruptive, threatening, abusive, harassing, or likely to cause damage to property, danger, distress, or upset to other participants or staff, whether communicated verbally, in writing, or in person, Protrek Adventure Pvt. Ltd. reserves the right to terminate your participation in the trip immediately and without any liability on its part. This includes but is not limited to: failure to follow safety protocols, disregarding guide instructions, violating agreements made prior to the expedition, or deviating from the set expedition route without authorisation.

17. Harassment and Group Dynamics
In all cases where a participant’s booking is terminated due to behaviour as described in Section 16, no refund or compensation will be paid and Protrek Adventure Pvt. Ltd. will not be responsible for any costs or expenses incurred by the participant thereafter. This includes situations involving harassment arising from flight delays, weather disruptions, or personal outcomes such as failure to summit.

Travelling within a group inevitably involves a degree of compromise to accommodate the diverse desires, pace, and physical abilities of all members. Protrek Adventure Pvt. Ltd. reserves the right to accept, decline, or remove any person from a group at any time, in the interest of the safety and enjoyment of all participants. You agree to adhere strictly to the discipline of the programme and to abide by the directions of Protrek Adventure Pvt. Ltd.’s organising authorities or their nominated representatives at all times.

18. Trek Insurance
Comprehensive and valid travel insurance is a mandatory requirement for all international participants, and must be obtained before the date of departure. It is strongly advisable, though not mandatory, for domestic participants to also obtain adequate insurance coverage. At minimum, your insurance policy must cover:

• Emergency medical treatment and hospitalisation
• High-altitude helicopter rescue and medical evacuation from remote regions
• Trip cancellation and curtailment
• Repatriation costs should you become too ill to continue
• Personal liability
• Loss of or damage to personal equipment

Protrek Adventure Pvt. Ltd. cannot be held responsible for any loss, cost, or expense arising from your failure to obtain adequate insurance coverage for all activities involved, including the altitudes to be reached. It is strongly recommended that your policy includes coverage for trip cancellation, interruption, and delays. Any additional expenses incurred for porters, vehicles, ambulances, hospitalisation, or evacuation during your trip will be the sole responsibility of the participant. Proof of adequate insurance may be requested by Protrek Adventure Pvt. Ltd. prior to departure.

19. Third-Party Service Providers
Protrek Adventure Pvt. Ltd. contracts with a network of third-party companies, government agencies, and individuals to assist in the operation of its treks and expeditions. To the best of our knowledge, these third parties are qualified and competent to perform the duties for which they are contracted. However, Protrek Adventure Pvt. Ltd. will not be held liable for any injury, damage, loss, negligence, delay, or irregularity that may occur as a result of the acts or omissions of these third parties.

Protrek Adventure Pvt. Ltd. acts as an agent for hotels, transportation companies, land operators, and other travel service providers. We assume no responsibility or liability in connection with the operation or service of any aircraft, motor vehicle, or other conveyance, restaurant, teahouse, inn, lodge, or hotel used in connection with our trips. Our operators and agents will not be responsible for any act, error, or omission, nor for any injury, loss, accident, delay, inconvenience, irregularity, or damage that may be caused by circumstances including acts of nature, civil disturbance, crime, terrorism, government restrictions, or failure of any means of conveyance to adhere to a published schedule.

20. Photography Rights
During all Protrek Adventure trips, photographs and video footage may be captured by our staff, guides, and expedition leaders. Such content may feature participants and may be used on our website, social media platforms, and in future marketing and promotional materials. Unless a participant explicitly notifies us in writing prior to departure that they do not consent to being featured, permission to use such content for the above purposes is deemed to be granted.

Participants who require a dedicated personal photographer for their trip are advised to book a package that includes this service for the full duration of the expedition. All content created by Protrek Adventure Pvt. Ltd. staff, guides, and expedition leaders remains the copyrighted property of Protrek Adventure Pvt. Ltd.

21. Acceptance of Risks
You acknowledge that adventure travel involves a significant degree of inherent risk, and you assume full responsibility for all such risks. You release Protrek Adventure Pvt. Ltd. and its authorized booking facilitator from all claims and causes of action arising from any losses, damages, injuries, illness, or death resulting from risks inherent in Himalayan travel and adventure activities.

You acknowledge that standards of hygiene, accommodation, and transport during our trips may be materially lower than those you are accustomed to in your home country, and that you have independently assessed and accepted these conditions. You must at all times strictly comply with all applicable laws and regulations of the regions visited. Failure to comply, or conduct that in the opinion of Protrek Adventure Pvt. Ltd. causes danger, distress, or material annoyance to others, may result in immediate termination of your participation, without entitlement to any refund for unused services or costs incurred, including return travel, accommodation, meals, and incidentals. You are personally liable for any costs incurred by Protrek Adventure Pvt. Ltd. for property damage, destruction, or theft caused by you during a trip.

22. Legal Entity & Liability Disclosure
All treks, expeditions, and on-ground services are run and operated solely by Protrek Adventure Pvt. Ltd., a local Nepal-based company (Registration No: 236688/076/077 | PAN No: 609744277 | Department of Tourism License No: 2845 | NMA Reg. No: 1526). ATS and its employees, shareholders, and officers neither own nor operate any person or entity which provides goods or services for these trips.

23. Booking Facilitation & Payment Processing
To serve our international clientele efficiently and securely, Protrek Adventure Pvt. Ltd. works with Adventure Travel Solutions (ATS), our India-based booking facilitator. ATS operates our global payment platform, handling booking coordination, invoicing, and payment processing. Charges processed will appear on your credit card or bank statement as ATS Pay. ATS is a facilitation entity only. It does not own, operate, or exercise any operational control over Protrek Adventure Pvt. Ltd. or any of its personnel, guides, vehicles, equipment, or expedition assets. ATS and its employees, directors, shareholders, and officers neither own nor operate any person or entity which provides goods or services for these trips. ATS assumes no responsibility and cannot be held liable for any personal injury, death, property damage, or other loss, accident, or delay which may be occasioned by reason of any wrongful, negligent, or unauthorized acts or omissions on the part of Protrek Adventure Pvt. Ltd. or its agents. All on-ground services remain the sole operational and legal responsibility of Protrek Adventure Pvt. Ltd.

24. Governing Law & Jurisdiction
By submitting your deposit, you formally accept these Terms and Conditions in their entirety. This creates a binding agreement with Adventure Travel Solutions for booking coordination and payment facilitation, and with Protrek Adventure Pvt. Ltd. for all on-ground expedition services. Any disputes relating to booking, payment processing, invoicing, or facilitation services shall be governed by and construed in accordance with the laws of India. Any disputes relating to on-ground operations, expedition conduct, guide services, logistics, or any services delivered in Nepal shall be governed by the laws of Nepal.

Both parties agree to attempt resolution of any dispute through direct negotiation prior to initiating formal legal proceedings. Protrek Adventure Pvt. Ltd. reserves the right to seek injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect its legal interests.

25. Privacy & Data Protection
Protrek Adventure Pvt. Ltd. and its authorized booking facilitator collect personal information, including name, contact details, passport information, emergency contact details, and health disclosures, solely for the purpose of administering your booking, processing payments, and ensuring your safety during the expedition. This information will not be sold to or shared with third parties except where required for legitimate operational purposes such as permit applications, insurance processing, or domestic flight bookings, or where required by applicable law.

By submitting a Booking Form or making a deposit payment, you consent to the collection, storage, and use of your personal data for the purposes described above. We reserve the right to disclose your personal information if we have reasonable grounds to believe that you are in breach of these Terms, or where disclosure is required by law or is related to a judicial or governmental investigation or proceeding.

26. Acceptance of Terms & Policy Amendments
Submission of a booking deposit constitutes your full, unconditional, and legally binding acceptance of these Terms and Conditions in their entirety. These Terms apply to all participants, including those booking through our authorized booking facilitator. All members of a group booking are deemed to have accepted these Terms in full.
